According to ancient tradition this Temple was first vowed by Romulus (the city founder)after a battle with the Sabines.
He consecrated a "templum" (= sacred area) to Jupiter Stator, "The Stayer" so this sanctuary originally was not an Aedes (Temple in the modern sense), more likely it was simply an altar enclosed by a low wall or fence.
The first temple building was built by Marcus Atilius Reguilus in 294bce on the same spot.
