I think they pay for all your costs.

 

Who does, the person you're suing? If so then that certainly makes it more worth your while.

 

In the US, you generally have to claim the cost of legal representation as something you're suing for, and I don't think you can always do that. And of course, you don't get that if you lose.

 

Likewise, if you are the one being sued, you are on the hook for your own legal costs whether you win or lose, unless you countersue for the legal costs as damages, which has no guarantee of success.

 

This enables a tactic known as "Slapping", where some entity will bully its target into complying with demands that they are not legally entitled to make merely by threatening to sue them. When faced with such a situation, you can comply with the demands of the threatening entity, thus ending things then and there, or you can proceed to litigation where you will probably win, because you are in the right, but will have to pay the costs of defending yourself in court (which many small entities may not be able to do) and deal with the headache of doing so. This takes advantage of the concept that "even if you win, you lose".

My best friend was actually approached by the woman he was suing (his former employer) about going on Judge Judy. He was suing her for unpaid wages. Now, in Pennsylvania, if an employer owes an employee (former or current) backdated wages and they don't provide them when requested, the Claimant has the right to sue for the wages + $500.00 + legal fees. This was indeed what he was suing for but he had no incentive to go on the show because whether he won or lost he was paid nothing more than $100.00 (or something insultingly low like that, I forget the precise amount) for his time, paid by the show. The Defendant, however, was to be paid the same. If she lost, the show would have paid my friend what she owed to him, so she would have made out either way. My friend would have been out of luck had he lost. He declined to go on the show and I don't blame him. In the end, she was ordered to pay by a local Magistrate but instead only approached my friend with the Judge Judy proposal and has since not paid my friend a dime.

The rainy season has started here.  We have a forecast for rain and clouds and little else for the foreseeable future.  This makes it difficult because we have laundry that needs to be hung outside to dry.  sigh

If I am going to make an appearance on TV, I would not want it to involve airing my personal drama to the world. Appearing on a show like Judge Judy is humiliation, not honor.

I mean, would you want to go on Jerry Springer, or Maury? Come on now.

    3792: We don't have Judge Judy or anything similar in Australia.

    Either way, I went to the wreckers and picked up two doors and a side panel for $200! That's half the parts sorted now.

    I had another friend who was on Montel years ago. That show is total bullcrap because when she appeared on set the producers changed the premise of the episode and just had her lie about why she was there. She showed me the tape. I had a good laugh.

    I remember Tracy Morgan from his short appearance on Jay and Silent Bob Strike Back.  He was funny, and I heard he was funny on 30 Rock, but I don't watch TV, so I'll never be able to verify this.  I hope he pulls through and that his family will not have to prematurely mourn him.

    3801: It's kinda sad when you realise that these things happen and are a part of life. I passed a three car accident today without batting an eye.

    That being said, I did find it eerie when I went to a scrapyard the other day to hunt down spare parts for my damaged car. Some of the damage was just astounding and it made me wonder what happened to the people inside the cars.

    Not necessarily as much as you might think. One of the beauties of modern automotive engineering is that the bodies of cars are designed to absorb large impact forces, under the basic principal that you'd rather destroy the car than destroy the person in it. There can be some very nasty-looking wrecks that people walk away from.

     

    Indeed, even in the case of the Tracy Morgan pileup, you have one person dead and a few seriously injured, but a lot more people who were in the accident who are relatively or completely fine.

    Has anyone hit animals with their car before? We get problems with feral deer in my area as well as kangaroos. Had one jump out in front of my car on a blind corner a while back.

    I had a friend in high school got her Ford Tempo's hood all bashed up by a deer (a rather common occurrence in Michigan), and another friend whose Dodge Dakota got totaled by what she claims was a bear.  I've rear-ended two people (very low speeds, no damage) and scuffed the passenger side of my Impreza (now no longer with us *sniff sniff*) on a too-narrow road that an idiot in a kei car decided to drive right down the middle of.  If I think about him too much, I'll start cursing.  Needless to say, morons here pose a bigger danger than animals.

    My driving has claimed the lives of a handful of small wild animals and thousands and thousands of flying insects, but I have never hit anything large enough to do damage. I did have a reeeaallly close call with a deer once, though.

    Eating roadkill is a redneck pastime.

    Having spoken to some people who've actually done this, they do make a sensible argument, though: why let perfectly good meat go to waste? They'd eat the same animal if they shot it while hunting, no reason it's less edible if it was killed by a car rather than a bullet.
