Breathalyzers are used but typically only after someone fails a field sobriety test. In order to best obtain a conviction in court, the prosecution would rather have both. The breathalyzer establishes a driver's BAC but says nothing about how impaired they are - that's what the field sobriety test is for.

 

It's also complicated because if you've been pulled over for DUI you can refuse to take a breathalyzer test. You will likely have your license instantly and automatically suspended for doing so (the law varies from state to state), but the cops cannot physically force you to take the test, because forcibly extracting evidence from a suspect violates the 4th and 5th amendments of our constitution.

 

Indeed, some lawyers will argue that it is in your best interest to refuse the test if you know you're over the limit since while you will get your license suspended, you may escape the DUI conviction if the court doesn't have that evidence to use against you. Depending on the state, having a breathalyzer refusal on your record may be preferable to having a DUI conviction.

What gets me are the varying laws of cell phone use from state to state. I refrain from texting while I driving but I can handle a call. States like NY don't allow it while PA still does. Calls, that is.

I imagine it'd be more annoying in areas like New England where you can travel between multiple states in a short period of time.  I lived on the border of Michigan and Ohio, and the only traffic law that I remember people paying a lot of attention to was motorcycle helmets.  When I was still living there I believe Ohio allowed you to ride without one while Michigan did not.  This might have changed, but I do remember that people would change at the border.

As a culture we at some point decided that safety precautions like helmets were unmanly and didn't look cool. To this day the people who sell safety equipment go to great lengths to make it look cool (flames printed on welder's masks, etc.), since if it doesn't look cool, a lot of people will refuse to wear it.

Its not about wearing one or not, Its about choice, Yes I perfer to and would wear a helmet but if I'm forced to I will refuse.

I'd rather wear a helmet as opposed to getting a concussion.  Plus, I take every safety precaution I can.  I worry about unlikely things happening.

I can certainly understand refusing to follow a stupid law, but realistically speaking, things like wearing a helmet or wearing your seatbelt are common sense. I don't like that you are required by law to wear a seatbelt but I'm not going to refuse to wear one in order to protest that, I would be putting myself at increased risk for no practical reason.

I used to say the same thing, larks. Lo and behold I have ultimately chosen to take a fair amount of precaution. These days I stretch before exercising, check myself for various forms of cancer and make sure to eat a well balanced diet... sorta. You'll find yourself doing mundane, ego crushing activities one day too. More to the point is that there are things I will not do now but would not have hesitated to do when I was younger. I rode my bike down a mountain and hit 46mph when I was 16 but I'm not trying to do that again this Saturday. No way. Oh yeah, even then I was wearing a helmet. :P

Another thing people do recklessly is drive.  Especially in New Jersey.  The thing is many people think they are invincible, immortal, and indestructible, which they are not.  Moral of the story, wear a helmet, use a seatbelt, don't drink and drive, etc.

    3887: Thick fog, rain and mountain roads. I wouldn't be recklessly driving tonight.

    Work was hardly fun though. It's surprisingly hard to get across to an intoxicated person that you won't serve them anymore.

    Never say never, Larks. There are many things in life that I've done which I once swore I would never do.

    As for being reckless in general, it's all fun and games until you start to realize there are consequences for it. Hopefully they don't involve getting maimed or killed but sometimes unfortunately they do. Hence why it is a bad idea.

    According to Mickey Rooney's (Night at the museum actor) wiki page He said "Always get married early in the morning. That way, if it doesn't work out, you haven't wasted a whole day."

     

    I found that quite humorous when I saw that.

    My aunt recently attended a wedding for some corporate bigwig's daughter at the Catholic Cathedral in Philadelphia. It apparently cost them $10,000 for the wedding. I don't know all the numbers, but 2000 to hold it at the Cathedral, 5000 some for dinner at an upscale restaurant nearby. What's crazy is they had people drive from the Cathedral (which in1864 they didn't think to have a lot of parking at) to the restaurant 2 blocks away. I would've walked.

    Anyway, it seems like weddings are far more anticipated than they used to be, and are more of a mass social gathering than something for the ones getting married.

    I know someone who's sister had a Star Wars themed wedding a few weeks ago. I didn't attend but I did consume the bottles of Light Side and Dark Side wine that were handed out. Homemade and yum.

     

    Edit: I actually haven't had the Pinot Noir yet but the white was yum...
