Copyright Infringement?

 Has anyone noticed that Discovery Channel's "Man Vs. Wild" has been using a snippet from one of the music tracks you hear sometimes in the 'region view' mode of SimCity 4? 

They air it when the host, Bear Grylls gets into a dangerous situation.  -Sounds like copyright infringement to me.

    "Probably"?  Hey, whatever...

    I thought you guys'd have someone look into whether they did have the licensing...then if they didn't, you could sue them for copyright infringement, and pay me 1/3, since I was the whistle blower.  : D

    They really blended this into the background, and as such it's not as blatant as it has been in other episodes.  You can hear it between 3:38 and 4:00.  (I stopped watching at this point, as I was a good hour into watching footage--but there might be another occurrence later in the episode.)

    Actually, it wouldn't be up to us to sue them, since we're just a fan site.  Jerry Martin composed the music for SimCity 4, so I would think that it'd be his decision whether to let other people use it (unless EA owns the rights to it, in which case it'd be EA's decision).  He's done work for commercials and stuff though, so I wouldn't be surprised if he let his work be used for the show.

    This topic has actually popped up a few times before, again with discovery and again with that sound, however it was the Docudrama "Supervolcano" that was the subject, not man vs. wild like this time. I'm assuming that the sound itself isn't copyrighted since it's not cut directly from the music of SC4. And it's being mixed in a different way in a different song. That's like suing a band because they have a 3 second segment in one of their sounds that sounds remarkably like it if you strip down just about everything else.

    I've heard that music in the YouTube clip before Tomb Raider the movie which came out in before SC4 in 2001. I thought that music sounded familiar when I first heard it in the game. I'm sure The Discovery Channel licensed it for use.

    Many times music is licensed for a number of different films and TV shows since its cheaper to buy music than to produce their own.

    Well, the EA would have a difficult time showing damages, so copyright law almost certainly does not apply.

    Also, you have no right to verify the licensing of proprietary material. Only the proprietor has the rights to examine the licensing and bring suit under the law.

    So nope, it's not a copyright issue at all.

    its like the muzak on the weather channel, somewhere some person makes a living composing instrumental music and then sells it to be used as background music

    It is probably not even EA's music clip. Like most of the photos you see in papers are licensed by photo agencies supplying both stock and current events photos.

    As TEG24601 said, the fire engine noise from SC3K can be heard everywhere on television. Also the snow sounds from Railroad Tycoon are frequently heard in programmes dealing with the Arctic/Antarctic or high mountains.

    No...it isn't.   It's the integral intro, and outroduction to a five-and-a-half minute music piece.  And the snippet they use is like a full five seconds--It's a very specific sound.

    I've heard SimCity music in several places before, documentaries, movie trailers, ambient music in a few TV shows, this isn't the first time it has showed up. I really don't think theres some big copyright infringement conspiracy here. Considering the music has been used a few times, I'm sure the legalities of it are taken care of.

    If it bothers you this much that Man Vs. Wild uses a bit of region music from SimCity 4, take it up with EA as I suggested earlier, because they are the ones who might actually be able to do something about this...and most of us here don't really care.

    do you honestly believe an entity as large as discovery is stupid enough to put themselves in a place where they could be sued? they have plenty of excellent lawyers just like EA and other television stations and major corporations...their lawyers wouldn't allow them to be that stupid...

    And don't you assume that this bit is EA's? How can you know, unless you're affiliated with EA in some way? And if you were, wouldn't the Legal Department be the right place for you?

    Um it isn't... I misread your post, typed that post, and closed the window after rereading before it posted (or so I thought)...  I refreshed the page a few times and didn't see the post show up, so I assumed it was gone.  The time stamp shows about 15 mins after I went to bed last night....  *sigh*
