It does, and there's even case history to support that.

However, while that case struck down Maryland's provision, nobody has yet challenged South Carolina's provision in the supreme court or attempted to remove it. North Carolina has a similar provision, which Cecil Bothwell holds public office in spite of.

...which is why I specifically say it's a de jure prohibition. De facto, it's not because it isn't going to be successfully enforced.

It, in fact, can't be challeneged without it being enforced. You need to have been prosecuted or denied something under a law or provision in order to make a constitutional challenge to it.

The state could move to ammend their constitution to remove the provision through their own means, but someone would need to bother to start the process and you'd need to get enough majority support for doing so. The latter may prove difficult on this matter in much of the US. Polls have shown that more than half of Americans (53%) would not be willing to vote for someone who is an atheist. Presumably more of them are concentrated in redder states (like the Carolinas). And presumably they would not vote in favor of removing a constitutional ban on atheists holding office, which might require a 2/3rds majority to pass.

Anyone else excited about the NHL Playoffs? They start this week. The NHL Discussion Thread hasn't been active all season, so if you have any Playoff or Stanley Cup picks, I'd love to hear them hear. Personally, I'd love to see The Penguins win, but New Jersey's got their number and are a tough team to beat. It may be their year.

Well, in terms of action, it's a lot of fun to watch. More so than football (American football) since there is always a break in the action. I rather enjoy watching Hockey, but having a good hometown team helps. Then again, I still watch The Pirates...
