Agree she resisted. Headlines could just as well read officer kills unborn infant after he attempted to restrain her by jumping on her back. We certainly don't want to give pregnant females the right everywhere to resist and walk away in fear we may potentially harm an unborn child that we do not even know existed in the first place. As far as your comment Smarty cops overdo Taser's that is absurd and you are generalizing a few isolated incidents as a whole. Do you have any idea how many officers still do not even have Tasers in America? How about the number that has them and what is their arrest ratio per Taser deployment. I am telling you know I have carried one for over a year and I have had not a single incident where I personally have deployed one. That's not saying they were not deployed. But the three times I have been in a physical confrontation while initating an arrest I was sure glad to get things over in a hurry versus risking injury to myself or the suspect; especially when we are rolling along traffic that is moving 70 miles per hour plus within inches of your head as you fight to win the battle. It just goes back to the old rule if you do not want force used against you do not give someone a reason to use such force.

Need we not forget the media does cut out bits and portions to spruce up this stuff. Some departments have cameras once activated will actually take footage from as much as five minutes prior to the activation of the lights (wish I had some of those). We are stuck in the stone age of key it up and pray they activate by the time you make contact. Often times viewing the whole video tells a different story. It's just to bad the news would not play the whole tape, even if it is 10 minutes of down time until things get good enough for television. Often times there are a lot of non-verbal cues leading up to an incident that will dictate how an officer will behave on re-contacting the offender. As for Duke's response I think the last few lines say it all. You have a much more creditable story before the judge if you comply and state your case. Otherwise things probably will not be in your favor when you appear for several misdemeanor and felony charges as a result of your poor decision making process that will ultimately be seen by the judge, if not the jury. My response to some of you folks making comments about corrupt law enforcement is get involved. Call up to the department and request a IA (internal affairs) contact and take action. The more details the better and video or audio is a plus. If you choose not to remain anyomus chances are they investigating officer will tell you why/how they handled your complaint and you will be more informed. I know I know some of you are already thinking cops policing cops yeah we will see how far that goes. Let me tell you first hand while I get along with IA (no reason not to if I'm not causing problems) I will be the first to tell you they scare the crap out of patrol officers who are guilty of misconduct. These are the police of the police and do a job I feel is much needed. No win from either side ( citizens or police depending on the outcome of the investigation) but they do what is right and if someone is in the wrong they carry a swift punishment. IA certinaly has no problem with throwing officers in jail if need be. -

As an law enforcement officer I would say there is nothing criminal that would warrant the officer being dismissed from his agency. If anything his agency should really consider some retraining in tactics and verbal judo. I have personally found myself in similar situations but I was able to talk some common sense into people. I feel the officer's poor use of tactics and commands led to an increase in use of force. I personally felt he took the necessary precautions to ensure his, as well as the offenders saftey, by deploying the Taser. If you pay close attention you will notice the offender is starting to reach in his pocket at the time the directions are given to place him under arrest. My question as a defense attorney (I always play devils advocate as well) would be why did you deploy the Taser when the male did not comply, yet when the female exited the vehicle you felt compeled to hold your handcuffs and play super cool by directing her back in the vehicle? If it concerns you that the Taser was deployed when the subjects back was turned my argument to that is that Taser has documented studies and specifically instructed officers that the most effective deployment is when it is shot into the pack as this is a major muscle area that will aid in compliance and limit injury. Hindsight is 20/20 people. Until you have walked in someone's shoes you will never truely appreicate why and how they do things the way they do. Kind of like construction workers everyone *****es when they delay a project, yet the same people *****ing are the first to complain when its not done right or they are impeding progress by traveling to fast and to close to workers to allow them to complete their work. -
