yeah that's pretty true, but then again the girl was two to three years older and much bigger... under these circumstances making the right choice wouldn't be as easy just out of plain fear..

... that is if it was the girls fault.  Also, more skeptisism about the story, rocks or no rocks an eleven year old girl that's much taller could easily outrun boys much younger.

but if it were the boys fault then they shouldn't be imprisoned, but their possible future actions should be taken into account for punishment.

Frankly I find it completely ridiculous to charge someone that young of any crime. They're not old enough to completely grasp that idea. They're also not old enough to actually understand sex, regardless of whether or not they know what it is (which I guarantee you they do. I did at their age). It seems to me they were more playing games than anything else. They probably heard about rape from some source which glorified it, and decide to go and reenact the idea in the schoolyard. You'd be surprised what kids can be capable of doing when they don't completely understand the topic at hand. I could provide personal experiences, but they're too graphic to go into here.

Yeah, they could use some shrink visits and some parental reprimand, but taking them to court? Really? Come on now....

OMG! How do they even know what sex IS? I know there are a lot of movies with sexual content, but theyre only 8 years old! What is this world coming to? 47.gif

I would hope they would not have to. There are too many other developmental issues that they have to deal with as a part of becoming 6 years old. This is the stage where children learn about boundaries and obtain the earliest sense of independence and self-control. This is where the earliest of fine motor skills (how to use one's hands to dress, eat, and write) begin. And the outside world expects them to know about sex???   How selfish is that (as a society)!!

They've stopped doing that in many states, especially for sex crimes.

Tis true rape no longer exists in the Canadian criminal code. Everything is called sexual assault now. The change was to remove some of the stigma victims face. This case would never have proceded in Canada because you have to be 10 or 11 (can't remember which) to be charged here.
