Well I'm driving regularly since one year and never had tickets or accidents (but a couple of near-accidents).

But I was lucky on several occasions.

- One time there was a cop car I didn't see that was on the shoulder. I passed him at 120km/h (around 70mph) and it was a 90km/h zone (around 50mph). I checked in my rear miror and he never moved.

-There was a road with a lot of stop signs on it I used to get to the job last summer. I was starting to work at 5:30 AM, so at this time there was always no traffic at all on the road. So I was usually speeding on the road and never stop at any stop signs. But one morning there was a cop car on a transversal street and when I saw it it was too late. But the cop car did nothing at all. I think the cop was sleeping in his car lol.

-Last month, I was out with my friends away of the city, on a small rural road. It was snowing like all, there was already 15 cm (6 inches) on the road. It was the first time I was driving on this road. Then a really tigh curve appeared out of nowhere (I didn't see it because it was on top of a slope, and the signalisation was also at the top of the slope, thus being blocked from the view). I entered the curve, but I knew was was going too fast, I didn't had the time to slow down and if I tried to break in the curve, I would have lost the control of the car because of all the snow. Anyway, I started skidding in the middle of the curve and lost the control. The car went in the opposite lane and I almost hit a car going in the other direction. I almost took control of the car but I finally did a 180

Sorry to tell you this, but it was not an "illegal" search.  The Fourth Amendment protects citizens from unreasonable searches, but there are several well known exceptions to the search warrant requirement. 

One of those is the "plain view" exception which basically means if an officer sees it, he/she can seize it.  The "plain view" exception has been expanded to include "plain smell", so if an officer smells contraband, then there is probable cause to conduct a warrantless search.

Finally, I'm glad to see your so proud of the fact that you get behind the wheel of a motor vehicle while you're under the influence of alcohol/drugs.  I'm sure the rest of the motoring public is thrilled by the fact that you have such little consideration for anyone else that you would put them at risk because of your immature attitude. face-icon-small-disgusted.gif

No matter what it's illegal to search your trunk and glove box without a warrent. He can look around the car all he wants. I know this because my lawyer told me. Btw I can drive the same when I'm under the influence as when I'm not. I've driven under a lot worse things. As long as I'm not mad, I won't do anything stupid.

Actualy its not. " Vehicle" includes any and all pars of the car. They cant go so far as disassembling peices like  slashing the tires open or  takeing off gas tanks and such  to look for stuff but the glove box and trunk are within the rules.your lucky they did not search your persons as well. although the way things are now
minor possesion is just a fine and is probaly why they let you off.

The cop did search us. He's just too stupid to actually find anything. And actually cops cannot enter locked possessions without a warrent. They can call a drug dog and if the dog finds something they can, but not until then.

That can't be a very accurate statement since by your own admission you had been drinking when you were pulled over for driving 68 mph in a 35 mph zone.  The other time you were drunk (as you put it) you were doing a 100 mph, lost control, and rolled your car into a ditch.  You broke your neck and should have been paralyzed.

I would call both of those incidents pretty stupid behavior.  You should be glad you didn't hurt or kill anyone besides yourself.  And if you don't consider that stupid behavior I would hate too see how stupid you really could be.

On the upside to your comments...your attorney gave you fairly accurate information.  Based on the details you gave, the officer could not have searched the vehicle's trunk or the locked glove box without a warrant.  I would point out though, that you didn't say anything about him searching either of those places in your original post.  And based on the details you did give, it would not have been any problem getting a search warrant if he had been inclined to do so.

There are circumstances that would allow him to "inventory" the car (including the trunk and glovebox) without a warrant, but that doesn't appear to apply in this situation.

I speed whether or not I have been drinking. I drive that fast all the time, even when I'm sober. Alcohol doesn't influence me to do anything differently. I know I do stupid things, but I like the adrenaline rush. And for the crash, I planned to do it. That's why I was in the middle of nowhere so I wouldn't affect anyone else. I really regret it all now, but at the time I was going through a lot of sh** and I really needed a way out. I know how stupid it was and I'm still paying for it today. So no one can make me feel any worse about it.

And I know I left out a few details, but you were suppossed to just read it and think to yourself "that's some sh**" or whatever you want to think and not try to prove me wrong.

And I don't care if a cop legally searches my car. Go ahead and get a warrent and do it the right way. I just get mad at pigs abusing their power and thinking they can do anything they want.


We all do stupid things, just some people take it a little further. beer.gif
