Big Brother isn't the only watcher

Cop charged with second degree murder.

 

Several videos of this incident went viral on the net.  Cop fired nine rounds (his whole magazine?) at the kid with a knife, isolated in a streetcar.

 

This incident has the Toronto police doing all their sums again.  I wonder if others will take note.

The YouTube video tells a lot. You can see the cop yelling at the guy to "drop the knife" for a good 40 seconds. Then, without the perp doing anything to escalate the situation (at least as far as we can tell from the video), the cop fires three shots at him. Now, that in and of itself is poor practice that merits some stern discipline but not necessarily a murder charge. The kicker that raises it to the level of murder is the fact that, several seconds later, after the guy is already down, the cop empties the rest of his magazine into him. Once you do that you can no longer make the argument that in the heat of the moment you felt you were acting in self defense. That's blatant aggression.

If he didn't 'drop the knife' that counts as escalation... You can't hold up a streetcar system all day. He did the only thing he could by shooting him, although you could kill him with a single bullet if fired accurately into his brain.

Not dropping the knife is not escalating the situation, especially if the guy does nothing else that could be seen as aggressive behavior towards the police. But okay, say the cop really did feel threatened, then shooting the guy is sort of understandable. But after the guy is down emptying your magazine on him is unforgivable. The guy was down, he was no longer a threat, there was no reason to use his body for some target practice. 

 

Besides, this guy is a cop, he is supposed to use only the minimum level of violence required to get the job done. If he can't do that, he has no place in the police force.

    My feeling is that the whole mob of cops (20?) standing around should be charged with apathy causing death, aiding and abetting a felonious fellow, or just general apathy.  It is not clear if any of them was senior enough to be considered the shooter's commander.  They all failed to protect the citizen after he was down.

    But someone else tasered the victim after the shooting.  The investigation continues. 

     

    My feeling is that the whole mob of cops (20?) standing around should be charged with apathy causing death, aiding and abetting a felonious fellow, or just general apathy.  It is not clear if any of them was senior enough to be considered the shooter's commander.  They all failed to protect the citizen after he was down.

    It's kind of difficult to protect someone who is down from sudden shooting, other than jumping in front of the shooter and risk getting shot yourself. 

     

    Not to mention that there is no way you can make that in court. The defense only needs one psychological expert explaining things like diffusion of responsibility and all those other cops walk free.

    Apathy isn't a crime Moose. 

     

    Besides a guy with a knife deserves to be shot. He sounds like a bad person innit.

    It is when it results in someones death. Though in this case I don't think you can really say the cops were all apathetic when it happened. 

     

    And no, no one deserves to be shot without a very good reason. Just having a knife in your hand is not a good reason.

  • The murder charge arises from the six shots when that idiot decided to empty his magazine into the already downed victim.  There was a significant pause.
